The Florida Legislature has passed a bill that preempts local governments from enacting rent control or rent stabilization ordinances, overriding efforts by several municipalities that had been exploring tenant protection measures. The bill, which is expected to be signed by the governor, prohibits cities and counties from capping rent increases or mandating lease renewal terms.

Supporters of the legislation argue that rent control policies discourage new housing construction and ultimately worsen affordability by reducing supply. Real estate industry groups, which lobbied heavily for the bill, say that market-based solutions combined with increased construction are the most effective way to address rising rents.

Tenant advocacy organizations and several city councils have condemned the measure, arguing that it strips local communities of the ability to protect vulnerable residents during a housing affordability crisis. Legal challenges are expected, with at least two municipalities announcing plans to test the preemption's constitutionality under Florida's home rule provisions.
